Terms and Conditions for Listing

Administration of Listings.

• It is your sole responsibility to upload Listings that you would like to designate for inclusion on the Website, and you shall provide all information, data and/or imagery necessary to include such Listing on the Website. You shall ensure that all such information, data and/or imagery is accurate at all times. No robot, spider or other automated service may be used to submit Listings to the Website.
• You represent and warrant that, for each Listing you submit to the Website, you have the right and authority to submit such Listings and associated information to Company, and you are not submitting the Listing on behalf of any party not authorized to list on the Website.
• You agree to provide Company with, and to maintain, accurate contact information (including a valid phone number and email address) in order to submit and maintain active Listings on the Website.
• You shall not post a Listing on the Website under a name, or using a contact, other than the business owner or the licensed broker or agent that is engaged by the business owner to market the Listing under a duly executed, active, exclusive listing agreement with the owner.
• You agree to allow submitted Listings, or any part thereof, to be searched, displayed, accessed, viewed, downloaded, copied and otherwise used by users of the Website and other Company partner and affiliated websites. Company shall have the sole authority to choose the manner in which any Listing will be searched, displayed, accessed, viewed, downloaded, copied, and otherwise used on such websites.
• Company shall have no obligation to monitor or verify the accuracy or proper use of the Website by others. However, Company may, in its sole discretion but without any obligation, search for and remove or modify Listings that are alleged to have been submitted in violation of these Terms of Use. Company reserves the right to remove all or any part of a Listing in its sole discretion. Company shall have no obligation to resolve any disputes that arise among users of the Website.
• Listings for business opportunities that are no longer active or available for sale must be immediately removed from the Websites; Listings that are not modified or renewed within a 365-day period may be automatically changed to “Off Market” and/or removed from the Website; you may not delete then re-submit the same Listing on the Website in order to affect the listing status.
• All communication from interested parties should occur through the contact form and/or phone number included on the contact form; by submitting any Listing, you agree not to include contact information within any other portion of the Listing, and that all images submitted for publishing represent the business opportunity or category exclusively, and do not include any contact information, broker logos, website addresses, or any overlay text or graphics of any kind.
• Only one Listing is permitted for each business opportunity on the Website, and each Listing on the Website may include only one business opportunity; a Listing for one business opportunity may not be modified or edited in an attempt to sell a different business opportunity.
• By submitting any Listing, you agree to ensure that all buyer inquiries relating to the Listing are responded to within 72 hours, that prospective buyers are provided, free of cost, the information reasonably necessary for such prospective buyer to make a fully-informed purchase decision, and that all responses are professional and respectful.
• You agree not to advertise a business as an “established business” or similar description unless such business (i) is open and has been continuously operating for a minimum of one year (two years for any Internet-based business), (ii) has an established customer base and revenue history, and (iii) can provide financial history information to qualified buyers
• Listings for on-line or Internet businesses must include the business URL and not the brokerage URL.
• Company may, in its sole discretion, prohibit or place additional limitations on Listings for certain business opportunity types (including, without limitation, cannabis or CBD, cryptocurrency, advertising for professional services, advertising for partial investments in a business, etc.).
• Company may require submission of the business’s URL, address, and/or other identifying information to enable Company to evaluate whether the Listing is appropriate for the Website.
